DISPUTES; CHOICE OF LAW; EXCLUSIVE JURISDICITION AND VENUE: This website is controlled and operated by GABBANELLI ACCORDIONS & IMPORTS LLC from its offices within the State of Texas, United States of America.  Purchasing products from this website constitutes a contractual agreement with GABBANELLI ACCORDIONS & IMPORTS LLC (the “Agreement”) and is governed by these terms and conditions.  The parties agree that this Agreement is made and is performable in Harris County, Texas and that exclusive venue for all disputes and litigation arising out of or in connection with this Agreement shall be in the state or federal courts located in Harris County, Texas and that both parties hereby consent and submit to the personal jurisdiction of such courts.  This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, without giving effect to any principles of conflicts of law or your actual state or country of residence.  Any party who unsuccessfully challenges the enforceability of this forum selection clause shall reimburse the prevailing party for its attorney’s fees, and the party prevailing in any such dispute shall be awarded its attorneys’ fees.

The parties to this Agreement agree that GABBANELLI ACCORDIONS & IMPORTS LLC has in no way purposefully availed itself to the jurisdiction of your actual state or country of residence.

Authenticity: Each Gabbanelli instrument is a one-of-kind product, manufactured with expert precision and superior materials by craftsman under strict quality control techniques. Due to the handmade production of these instruments, each has its unique characteristics demonstrating its originality and authenticity. Because all Gabbanelli instruments are hand-crafted, there are not two products that are exactly alike. We cannot complete orders that request multiples of the same products.

Colors: We have done our best to display as accurately as possible the colors of the products shown on the Gabbanelli.com website. However, because the color you see will depend on your monitor, we cannot guarantee that your monitor’s display of any color will be one-hundred percent accurate.

Availability: It is our policy to only accept orders for items we have in stock. We show all items available from our online store however, if an item is unavailable it will be listed as “Temporarily Out Of Stock” and will be unavailable for purchase. Types of product and inventory change daily and we advise you to check back frequently for your hardware and gear needs. Product orders with incorrect pricing or typos will not be honored.

Checkout: Due to the real-time nature of the Internet, there is a rare possibility that multiple people could be placing order(s) for the same product just seconds before you. To address this, we have set a final inventory check on a product prior to the order confirmation, therefore an item’s availability or quantity may be updated at this point. If an item becomes unavailable, you will notified prior to the order confirmation.

Funds/Payment: Gabbanelli Online Store only accepts orders over the Internet. The Gabbanelli Online Store currently accepts most major credit and check cards including:

Sales Tax: Sales tax is calculated to the State of Texas. Tax is calculated according to local tax laws in the jurisdiction where the order is shipped.

International Shipping and Sales or VAT Tax: If you are shipping to a country outside the U.S., Gabbanelli Online Store will charge you for any applicable import tax, customs duty, brokerage fees, or VAT charges. Any additional charges (if required by your country) will be billed at time of purchase. Customer will be contacted to confirm order and all applicable fees.

Gabbanelli Online Store is required by U.S. law to declare an accurate monetary value on all shipments.

Payment Safety: With the Gabbanelli Online Store, you can order online with confidence. The Gabbanelli Online Store uses the latest SSL encryption technology (the internet standard for secure transactions) to protect your credit card and/or banking information.

SHIPPING

Shipping: All orders are shipped Tuesday – Friday via FedEx. Shipping amounts are calculated according to the carrier rates and a small handling fee. All shipping and handling fees will be displayed during the checkout process.

We are unable to ship orders to P.O. boxes or APO/FPO addresses.

Shipments: Our warehouse hours are Tuesday – Friday, 9:00 a.m. to 5:00 p.m. CST, closed Saturday, Sunday, Monday and U.S. holidays. When you order from Gabbanelli Online Store during regular business hours Tuesday-Thursday and before 3:00 p.m. on Friday, your order will typically leave our warehouse the next business day.

Delivery Times: The information supplied below is an estimate and no shipping delivery time can be guaranteed. For more shipping information, please contact your local FedEx store at https://www.fedex.com/

FedEx Home Delivery: Delivery in 1–5 business days within the contiguous U.S.; 3–7 business days to and from Alaska and Hawaii.

FedEx 2Day: By 4:30 p.m. in 2 business days to most areas (by 7 p.m. to residences).

FedEx Standard Overnight: Next-business-day delivery by 3 p.m. to most U.S. addresses; by 4:30 p.m. to rural areas.

FedEx International: Delivery in 1–5 business days.

Warranty: Gabbanelli Online Store offers the following warranty on its product offerings:

LIMITED WARRANTY: The manufacturer warrants the Gabbanelli Instrument you have purchased for ONE YEAR from the date of purchase against defects in workmanships and/or materials. This warranty only covers the parts that prove to be defective during the period of warranty and will either be repaired or replaced at our discretion. Reeds and tuning are also warranted for 6 MONTHS. Should tuning or repair become necessary during the warranty period, send product and prepaid postage or freight to: Gabbanelli Accordions 4991 W. Bellfort, Houston, TX 77035. This warranty does not apply if damage occurs due to improper handling or operation, accident, abuse, misuse or unauthorized repairs. This Gabbanelli Instrument is Guaranteed against any defect in material, mechanism or workmanship for a period of ONE YEAR from the date of purchase provided that the Registration form was filled out and returned to us or completed online within ten days from date of purchase. If the instrument should prove defective in any of these respects and the purchaser has conducted proper care and usage, we guarantee to repair or replace, at our discretion, the unsatisfactory part(s). This Guarantee applies only to the original purchaser and is not applicable if damages are a result of mishandling, improper care, body acids, accident or climatic change, or if the serial number has been tampered with.

Exchange and Replacement Policy

Customer must examine all goods within 24 hours of receipt to receive full credit for exchanges or replacements on incorrect shipments. Gabbanelli reserves the right to charge a 20% restocking fee for any exchanges.

No other type of exchanges or replacements will be accepted.

Warranty Policy

Customer is responsible for 100% of shipping cost for shipments due to warranty repairs after 7 days of receipt.

Failed Delivery Policy

Shipping cost and 20 % restocking fee will be billed to original purchaser for any refused shipments.

Return Policy: All Sales are final, but depending on the return situation and condition of product, returns may be subject to a 20% restocking fee.

You must obtain and include a Return Merchandise Authorization Number. The RMA number is obtained by contacting our Customer Service Dept. Customer Service at 1-800-244-0763 (U.S. only, Tuesday- Friday 10 a.m. – 6 p.m and Saturday 10 a.m. – 5 p.m., CST) or 01-800-681-1594 (Mexico only, Tuesday- Friday 10 a.m. – 6 p.m and Saturday 9 a.m. – 5 p.m., CST) or by sending an email to cservice@gabbanelli.com with your questions. This RMA number must appear on the outside of the returned package(s). Buyer is responsible for all return shipping charges.

Product must be in the original packaging complete with all collateral materials such as mounting hardware, care kits, hang cards, certificates of authenticity, warranty cards, manuals, and any other materials that originally shipped with the product.

Contain copy of sales receipt generated at time of sale.

Returns missing any of the above are subject to refusal or a 20% restocking fee at Gabbanelli’s discretion. Returns purchased from the Gabbanelli Online Store may only be made through Gabbanelli Customer Service.
